Terms of Service

1. The service

Operator Cockpit is a workforce operations service for food-service businesses: scheduling, shift swaps, tasks, training, and team chat. It is provided by BPN Solutions LLC ("we", "us"). By using the app or website you agree to these terms and to our privacy policy.

2. Accounts and access

• There is no self-service sign-up. Accounts are created when a business owner or manager adds a person to their team roster. Your access exists through, and depends on, your employer's use of the service.
• Your employer controls its workspace: who is on the roster, each person's role, and whether your access continues. If your employer removes you or its agreement with us ends, your access ends.
• Sign-in uses one-time codes sent to your email or phone. Keep those codes to yourself and tell us if you believe someone else has used your account.
• You must provide accurate information and use the account assigned to you, not anyone else's.

3. Your content

• You own the content you create (messages, photos, and similar). You grant us a non-exclusive license to host, store, and display it within the service so the product can work. The license ends when the content is deleted, except for backups and copies already shared with others through normal use.
• The app is a workplace tool. Content you post in a workspace (chat messages, task photos, schedules) is visible to the people at your workplace that the app shows it to, including owners and managers.

4. Acceptable use

You agree not to:

• use the service for anything unlawful, or to harass, threaten, or abuse anyone;
• scrape, bulk-export, or harvest roster or contact information, or use it for solicitation or recruiting outside your workplace;
• probe, disrupt, or interfere with the service, attempt to access another business's data, or reverse engineer the software;
• upload content you have no right to share, or malicious code.

We may suspend or terminate access for violations. Business owners and managers are responsible for how their workspace is used.

5. Not a system of record

Schedules, hours, and pay figures shown in the app are planning tools and estimates, not payroll, timekeeping, or legal employment records. Your employer's official records govern wages, hours worked, and employment decisions. We are not your employer and are not a party to any employment relationship or dispute between you and your employer.

6. Availability and changes

The service is provided "as is" and "as available." We work to keep it running but do not guarantee uninterrupted availability, and we may change, add, or remove features. We may update these terms; if we make material changes we will update this page and the date at the top, and continued use after that constitutes acceptance.

7. Disclaimers and liability

To the maximum extent permitted by law, we disclaim all warranties, express or implied, and our total liability for any claim relating to the service is capped at the greater of the amounts paid to us for the service in the 12 months before the claim or $100. Claims must be brought within one year of the events giving rise to them. Nothing in these terms limits liability that cannot be limited by law.

8. Disputes

These terms are governed by the laws of the State of Indiana. Any dispute that cannot be resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association, seated in Indiana. You and we each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration clause by emailing support@bpnsolutions.com within 30 days of first accepting these terms.
